Maliki Usul al-Fiqh

The Malikis have made some excellent contributions to the study of Usul al-Fiqh. The following works are considered essential in a curriculum for Malikis:

  • Sharh al-Waraqat by al-Hattab
  • al-Isharat fi Usul al-Fiqh by al-Baji
  • Maraqi al-Su’ud with the Sharh Nathr al-Wurud by Muhammad al-Amin al-Shanqiti
  • Taqrib al-Wusul by Ibn al-Juzay
  • Ihkam al-Fusul by al-Baji
  • Miftah al-Usul by al-Tilimsani (for takhrij al-furu ‘ala al-usul)
  • al-Furuq by al-Qarafi
  • al-Muwafaqat by al-Shatibi

A number of key works are missing, but this should give a good grasp of Maliki Usul. Mastery requires reading widely and critically engaging with the field.

    You’ve left out some very important works:
    Sharh tanqih al-fusul and Nafa’is al-usul by al-Qarafi.
    Muntaha al-sul wal-amal by Ibn al-Hajib.
    al-Taqrib wal-Irshad by al-Baqillani.
    Murtaqa al-wusul and Mahya’ al-al-wusul by Ibn Asim
    Fath al-wadud, Bulugh al-sul and Isal al-salik by al-Wulati al-al-Shinqiti.
    Durar al-usul by Ibn Buna al-Shinqiti.
    al-Diya al-lami by Hululu.
    Commentaries of Qarafi’s Tanqih by Hululu and Ibn Ashur
    Maqasid al-sharia by Ibn Ashur.

    Jazak Allahu khayran for your contribution. I deliberately kept this list brief as an indication of a curriculum of sorts which could realistically be accomplished. Mastery required extensive readings of many other works in usul al-fiqh, including those that you have listed (to which I am grateful).

    I am also no specialist in Maliki fiqh and thus picked out the choicest texts from several recommendations by peers.

    Maqasid al-Shari’ah is another branch which needs a separate post and Ibn Ashur is definitely required reading in that field.
